In Honduras, as in many Latin American countries, all relevant acts or contracts, including real estate transactions, must be documented by Notaries as only the instruments issued by them can be recorded. As per the Honduran Notarial Code, Notaries are “ministers of public faith” in charge of documenting all the acts or contracts placed before them by the contracting parties. Therefore, the intervention of Honduran Notaries in the issuance of acts or contracts in Honduras is of a delicate nature, since they are responsible not only for the date and signature on the documents, but also for their content and therefore, must insure that all the requirements required for their registration, if needed, are met.
